1. Parties and definitions
“Operator” or “CostaDrive” means the operator of the website costadrive.top and related booking and partner services, contactable at:

“User” means any person accessing the Website. “Renter” means a User who requests or completes a vehicle rental booking. “Owner” or “Partner” means a User who lists vehicles or provides vehicles for rental through the platform. “Services” means the Website, booking facilitation, communication tools, and related features offered by the Operator.
2. Nature of this document (public offer)
These Terms of Service constitute a public offer within the meaning of applicable contract law: they set out the conditions on which the Operator provides access to the Website and the Services. By registering, submitting a booking request, completing a payment where applicable, or otherwise using the Services in a manner that implies agreement, you accept these Terms in full. If you do not agree, you must not use the Services.
The specific rental of a vehicle may additionally be governed by a separate rental agreement, vehicle handover documents, and the Rental Conditions published on the Website. In case of conflict, the specific rental agreement concluded for that booking prevails for rental-specific matters; these Terms govern use of the platform and general legal relationship with the Operator.
3. Description of the Services
The Operator provides an online platform to discover vehicles, submit booking requests, communicate regarding rentals, and process payments where integrated. The Operator may act as intermediary between Renters and Owners or operate under a model where rental obligations are allocated as disclosed at booking. Vehicle availability, pricing, and fulfilment depend on Owners and third parties; the Operator endeavours to display accurate information but does not warrant uninterrupted error-free operation of the Website.
4. Eligibility
You must be at least 18 years old and have legal capacity to enter binding obligations. Renters must meet driver and document requirements stated in the Rental Conditions. Owners must provide truthful information and valid documentation for vehicles and payouts.
5. Bookings, prices, and payment
Displayed prices, fees, deposits, and cancellation rules are shown before confirmation unless otherwise stated. Payments may be processed through third-party payment providers (e.g. Stripe). By authorising payment, you agree to the provider’s terms and to charges as disclosed at checkout. The Operator may charge commissions or service fees as disclosed to Owners or in the booking flow.
6. Cancellations and refunds
Cancellation and refund rules depend on the fare type, Owner policy, and timing of cancellation as shown at booking or in your confirmation. Unless mandatory consumer law provides otherwise, refunds are processed according to those rules. Chargebacks or payment disputes may result in suspension of accounts pending resolution.
7. User conduct
You agree not to: misuse the Website; circumvent security; scrape data without permission; upload malware; impersonate others; use the Services for fraud or unlawful purposes; or infringe intellectual property or privacy rights. The Operator may suspend or terminate access for breach.
8. Intellectual property
The Website, branding, text, graphics, and software are owned by the Operator or its licensors. You receive a limited, revocable licence to use the Website for personal or legitimate business use in connection with the Services. No licence is granted to copy, modify, or exploit materials beyond what is necessary for normal use.
9. Limitation of liability
To the fullest extent permitted by Spanish law, the Operator is not liable for indirect, consequential, or punitive damages, or for loss of profit, data, or goodwill, arising from use of the Services. The Operator’s aggregate liability for direct damages arising from these Terms or the Services in any twelve-month period is limited to the amount you paid to the Operator for the specific booking giving rise to the claim (excluding amounts passed through to Owners or payment processors), except where liability cannot be limited by law (including death or personal injury caused by negligence, or fraud).
The Operator is not liable for acts or omissions of Owners, Renters, or third parties (including vehicle condition, traffic accidents, or insurance disputes). Users are responsible for verifying insurance and rental terms at handover.
10. Indemnity
You agree to indemnify and hold harmless the Operator against claims, damages, and costs (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or violation of third-party rights, except to the extent caused by the Operator’s gross negligence or wilful misconduct.
11. Consumer rights (Spain / EU)
If you qualify as a consumer under Spanish and EU law, you benefit from mandatory rights that cannot be waived, including rights under consumer protection regulations and, for distance contracts, withdrawal rights where applicable. Nothing in these Terms excludes those mandatory rights.
12. Privacy and cookies
Processing of personal data is described in our Privacy Policy. Use of cookies is described in our Cookie Policy.
13. Amendments
The Operator may modify these Terms. The updated version will be posted on the Website with a revised “Last updated” date. For material changes, we may provide additional notice where appropriate. Continued use after the effective date may constitute acceptance where permitted by law.
14. Governing law and jurisdiction
These Terms are governed by the laws of Spain, without regard to conflict-of-law rules that would refer to another jurisdiction. For consumers resident in the EU, you may also benefit from mandatory provisions of the law of your country of residence.
Subject to mandatory consumer jurisdiction rules, the parties submit to the courts of Alicante, Spain, for disputes arising from these Terms or the Services. The European Commission provides an ODR platform for online dispute resolution: ec.europa.eu/consumers/odr.
